The Facts.—The plaintiff's goods were forwarded for transport to Vienna on one of the lines of the defendant State Railways on 18 October, 1918. The plaintiff claimed for loss and damage and contended that the defendant Railway Administration was liable under the terms of the Berne Convention of 1890 concerning Railway Transports and Freights.

Held by the Supreme Court of Hungary: That the claim must be dismissed. At the time of the said transport the Berne Convention was, in accordance with its first Article, to be applied to transports from the territory of one of the contracting States to the territory of another by virtue of a direct freight note.
