Conditions of Extradition — Extradition to a State of a Person not its National — Lawful in absence of Contrary Treaty Provision.

The Facts.—This was a request for extradition by an Austrian court. The crime was alleged to have been committed in Austria and Poland by a person resident in Budapest. The accused stated that he was a Roumanian citizen and, should the request of the Austrian court be granted, he asked to be extradited to Roumania, and not to Austria.
